This terms of service is a legal contract between you and BrewSurvey (brewsurvey.com), governing your use of mobile, web services or web software ("BrewSurvey") owned, controlled or offered by BrewSurvey.
PLEASE READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS OF SERVICE. BY USING THE BrewSurvey SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THE TERMS OF THIS “TERMS OF SERVICE”. IF YOU DO NOT AGREE TO THIS TERMS OF SERVICE, PLEASE CEASE USING THE BrewSurvey SERVICES IMMEDIATELY. BY CONTINUING USE OF BrewSurvey SERVICES, YOU CONSENT TO RECEIVE PERIODIC EMAILS AND CALLS TO HELP YOU BETTER USE BrewSurvey.
You agree to obey all the applicable laws of your country regards to the use of BrewSurvey software. You must own the smartphone or tablet or have written permission from the owner of the smartphone before downloading, installing, activating BrewSurvey software on that phone.
YOU UNDERSTAND AND HEREBY ACKNOWLEDGE AND AGREE THAT YOU MAY NOT AND WARRANT THAT YOU WILL NOT:
Use the BrewSurvey Services for any illegal purpose, or in violation of any laws, including, without limitation, laws governing intellectual property, data protection and privacy, and import or export control.
Remove, circumvent, disable, damage or otherwise interfere with security-related features of the BrewSurvey Services, features that prevent or restrict use or copying of any content accessible through the BrewSurvey Services, or features that enforce limitations on use of the BrewSurvey Services.
Intentionally interfere with or damage operation of the BrewSurvey Services or any user's enjoyment of them, by any means, including uploading or otherwise disseminating viruses, worms, or other malicious code.
Post, store, send, transmit, or disseminate any information or material which infringes any patents, trademarks, trade secrets, copyrights, or any other proprietary or intellectual property rights.
Use any robot, spider, scraper or other automated means to access the BrewSurvey Services for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the BrewSurvey Services or modify the BrewSurvey Services in any manner or form, nor to use modified versions of the BrewSurvey Services, including (without limitation) for the purpose of obtaining unauthorized access to the BrewSurvey Services.
Sell, transfer or allow another person to access your account password or BrewSurvey Services account
Download, Install or Activate BrewSurvey on a smartphone that is not owned by you or you do not have written approval from the owner to do so.
Breach the federal, state, regional or any government laws of your country by downloading, installing or activating BrewSurvey Software on someone's smartphone.
Collect data using BrewSurvey software from a smartphone, which is not owned by you without the knowledge and consent of the owner of the smartphone.
If you have registered to use certain Services and/or Software on a trial basis, then you may use such Services and Software only for evaluation purposes during the applicable trial period.
Your access to or use of the Services and/or Software after completion of free trial shall be contingent upon your payment of all applicable fees as described on the Site from time to time referred to as (“Subscription”).
After completion of the free trial, you will be required to designate a valid credit card. You hereby authorize BrewSurvey to charge to your designated account all Fees relating to the Services you select, and you agree to pay all such Fees in accordance with the applicable card member agreement.
BrewSurvey reserves the right to revise its Fees, including by increasing or adding new Fees, at any time on five (5) days’ notice. Such notice may be sent to you by email to your most recently provided email address or posted on the Site or by any other manner chosen by BrewSurvey in its commercially reasonable discretion. You will be deemed to have received any such notice that is posted on the Site on the day it was posted. Your use of the Services after the five (5) day notice period constitutes your acceptance of the new or revised Fees. If you do not agree to the revised Fees, you may cancel your subscription.
To ensure uninterrupted service, all subscriptions to the Site, Software and Services are renewed automatically. You hereby authorize BrewSurvey to charge subscription Fees for the renewal period to the credit card on file. All subscriptions are renewed at the subscription level(s) in effect at the time the then-current subscription term ends. You may cancel the subscription at any time.
